Man arrested with burglary tools outside Rochester apartment complex

A Rochester man is behind bars thanks to a tip from an alert resident.

Police responded to Bear Creek Apartments, 1455 Marion Road SE, just after midnight Monday for a report of a suspicious person with a flashlight.

When officers arrived, they found Joshua Battey, 38, riding a stolen bicycle near the apartment building. His backpack contained a pry bar, sheet metal cutter, bolt cutters and some illegal prescription pills, according to a police report.

Battey faces a felony charge for possession of burglary tools. Court records show he was on probation for a recent disorderly conduct charge involving fighting.
